DMCA & Copyright Policy

Navitek respects the intellectual property rights of others and expects users of Clippeak ("Service") to do the same. This policy outlines our response to claims of copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and other applicable copyright laws.
1. Our Policy on Copyright Infringement
Clippeak is a processing tool that operates on URLs of publicly accessible YouTube videos provided by users. We do not host, cache, or distribute full copies of YouTube videos on a long-term basis. Generated clips are stored temporarily on our servers for a limited period, solely to allow the user who created them to download their output.
We take copyright infringement seriously. We will respond promptly to valid DMCA notices and will remove or disable access to allegedly infringing content. We reserve the right to terminate the accounts of users who repeatedly infringe copyright.
Important: Clippeak is a tool. Users are solely responsible for ensuring that their use of the Service complies with applicable copyright law. We expressly prohibit using Clippeak to infringe the intellectual property rights of others. If you are unsure whether your intended use is lawful, consult a legal professional.
2. Safe Harbor & Service Provider Status
Navitek operates Clippeak as a neutral service provider. We do not initiate the transmission of any video content, do not select the content processed by the Service, and do not select the recipients of any output. All processing jobs are initiated solely at the direction of individual users.
Specifically:
- We exercise no editorial control over the YouTube URLs submitted by users or the clips they generate
- We do not review, monitor, or curate user-submitted URLs or output clips for copyright compliance before or after processing
- We receive no direct financial benefitspecifically attributable to any infringing activity — users pay for processing capacity regardless of the content processed
- We act expeditiously to remove or disable access to allegedly infringing material upon receipt of a valid DMCA notice
We intend to qualify for safe harbor protection under 17 U.S.C. § 512 (DMCA) and equivalent provisions under applicable law. Nothing in this policy creates an obligation on Navitek to monitor user activity or content.
3. Filing a DMCA Takedown Notice
If you believe that content generated through Clippeak infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be valid under the DMCA, your notice must include all of the following elements:
- Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of such works
- Identification of the infringing material — A description of the material you claim is infringing, with sufficient detail for us to locate it (e.g., a URL, job ID, or clip identifier)
- Your contact information — Your name, address, telephone number, and email address
- Good faith statement — A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- Accuracy statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
- Physical or electronic signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf

Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the allegedly infringing material and will notify the affected user.
Note: Submitting a false DMCA notice may expose you to liability under 17 U.S.C. § 512(f), including damages, attorneys' fees, and costs.
4. Counter-Notice Procedure
If you believe that material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:
- Identification of the removed material — A description of the material that was removed and where it was located before removal
- Statement under penalty of perjury — A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your contact information — Your name, address, and telephone number
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the courts of the Republic of Indonesia, or, if you are located outside Indonesia, any competent court in the jurisdiction in which Navitek operates or may be found
- Physical or electronic signature
Send your counter-notice to the same contact above. Upon receiving a valid counter-notice, we will forward it to the original complainant and may reinstate the removed material after 10–14 business days unless the complainant files a court action.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have a policy of terminating accounts of users who are determined to be repeat infringers, in appropriate circumstances and at our sole discretion.
We define a "repeat infringer" as any user who has had content removed due to multiple verified copyright claims, or who has been notified of potential infringement on more than one occasion.
6. Fair Use
Clippeak is designed to support lawful uses including commentary, criticism, news reporting, teaching, scholarship, and research — activities that may qualify as fair use under 17 U.S.C. § 107 or equivalent provisions in other jurisdictions.
